This has been an interesting year for the board. We are trying to improve the area and keep it safe. This board has a lot of knowledge of the history of the area and connections to find out what is going on where.
Please drive carefully... we have kids, pets and lots of wildlife in the area, there are posted 30 and 25 mph speed zones in the Ranch.
There was a strong storm in Spring 2016 that blew the tennis court fence over... who knew bushes could form a sail? The HOA board has fixed and fortified the fence and it should be good to go for a long time. Thanks goes out to the board members who volunteered more time to fix the fence and clean-up the tennis courts once cement set.
We had a great turn out for the community clean-up. This is one service the HOA provides that is greatly appreciated. Every year we get more residents of the Ranch using this service. Everything gets more expensive over the years and this is no exception. The board will be considering its options for next year. Look to the newsletter to see what changes are made. Again, thanks go out to the board members who managed the trash drop off organization, implementation and donated a few days of their time to be on the site for the HOA. Status of the Residential Rehab facility on Spruce Road: The Board of County Commissioners has continued the stay on prosecution as long as all rehabilitation services are relocated. The Rehabilitation Facility has decided not to expand at this time. We are continuing to monitor this situation and are hoping the covenant changes will bolster the HOA Board position that this is a nuisance business that is not in line with a Single Family Residence. If any residents see something suspicious please report this to the El Paso County Sheriff... either 911 for emergencies or non emergency number:390-5555. Please check the Tri Lakes Fire Department website, www.tlmfire.org , from time to time to check our fire status. We are in a Stage 1 fire alert and dropping cigarettes on the side of the road is not allowed. This is a crime and hazardous for the entire ranch.
The proposed Monument town water tank is in Forest View Acres IV on Lot Number 6, Forest View Way. This is not in our HOA, but we have thrown our support that this is not appropriate for a residential neighborhood. Forest View HOA has filed a lawsuit against the town of Monument because this is not a residential use and the town of Monument was offered another site. We will continue to monitor this situation and see how it develops in the future.

9. A request to have the Board of County Commissioners authorize the County Attorney to pursue litigation in order to bring the property at 18375 Spruce Road into compliance with Table 5-1 Principal Uses, which identifies that operation of a rehabilitation facility is not an allowed use in the RR-0.5 (Residential Rural)zone district. The property is located in Forest View Acres subdivision, west of the Town of Monument. (Parcel No. 71170-03-016). BOCC ACTION: GLENN MOVED/LITTLETON SECONDED TO ADOPT THE RECOMMENDATION TO PURSUE LITIGATION AT 18375 SPRUCE ROAD WITH THE ADOPTION OF THE PROPOSED STIPULATION AND THE MODIFICATION AS REFERENCED BY THE COUNTY ATTORNEY AS FOLLOWS: THE APPLICANT WILL ADMIT, AND HAS ADMITTED, TO THE VIOLATION AS A REHABILITATION FACILITY IN A RESIDENTIAL AREA AND WILL CURTAIL ANY REHABILITATION FACILITY USES IMMEDIATELY. IN EXCHANGE FOR THE STIPULATION, STAFF WOULD RECOMMEND TO THE BOARD:
1) RECOMMEND AN ABBREVIATED HEARING TO PRESENT THE STIPULATION. STAFF WOULD FURTHER RECOMMEND THAT NEIGHBORHOOD TESTIMONY BE LIMITED TO THE TOPIC OF THE STIPULATION.
2) APPROVE AUTHORIZATION TO ENFORCE, BUT STAY UNTIL NOVEMBER 3, 2016, FOR THE FOLLOWING:
a) ALLOW UNTIL NOVEMBER 3, 2016 TO FILE A VARIANCE APPLICATION AND HAVE IT DEEMED COMPLETE BY PLANNING AND COMMUNITY DEVELOPMENT DEPARTMENT (PCD). WITHIN THIS TIME, APPLICANT WILL SUBMIT A COMPREHENSIVE LIST OF CURRENT ACTIVITIES/USES AT THE SUBJECT PROPERTY, AND STAFF WILL WORK WITH APPLICANT TO INDENTIFY THOSE USES THAT ARE REHABILITATION FACILITY-TYPE USES THAT ARE NOT ALLOWED IN THE RESIDENTIAL ZONING DISTRICT AND THAT APPLICANT AGREES TO REMOVE THOSE USES WITHIN 24 HOURS.
b) APPLICANT AGREES THAT IT WILL ALLOW HIPPA COMPLIANT INSPECTIONS OF THE SUBJECT PROPERTY BY THE COUNTY WITHOUT NOTICE TO CONFIRM THE CURRENT USE IS NOT A REHABILITATION FACILITY.
c) APPLICANT AGREES TO LIMIT PARKING TO 3 VEHICLES IN THE GARAGE AND 4 VEHICLES IN THE DRIVEWAY.
d) THE COUNTY WILL PROVIDE COPIES OF PUBLIC RECORD-TYPE DOCUMENTS TO THE RED ROCK RANCH, FOREST VIEW ACRES & CLOVENHOOF HOA, INCLUDING RESULTS OF INSPECTIONS, TO KEEP THE HOA APPRISED OF APPLICANT’S COMPLIANCE WITH THE TERMS OF THIS STIPULATION.
3) IF AN APPLICATION FOR A VARIANCE IS RECEIVED BY PCD AND SAID APPLICATION IS DEEMED COMPLETE, AS DETERMINED BY PCD, BY THE NOVEMBER 3 DEADLINE, THEN THERE SHALL BE A FURTHER STAY ON ENFORCEMENT PENDING THE FINAL BOARD DECISION OF THE VARIANCE PROVIDED THAT: - THE APPLICANT DILIGENTLY PURSUES, AS DETERMINED BY THE PCD DIRECTOR, THE VARIANCE APPLICATION REQUIREMENTS, INCLUDING NOT BRINGING ANY REHABILITATION FACILITY ACTIVITIES BACK TO THE PROPERTY DURING THAT TIME. - IF THE VARIANCE IS APPROVED, THE COUNTY WOULD NOT ENFORCE, BUT IF DENIED, THEN COUNTY WOULD IMMEDIATELY ENFORCE AS MAY BE APPROPRIATE.

Greetings RRRHOA Resident,
As the board continues to track and take action on the activities in the association on Spruce Road that the board considers to be in violation of the association covenants, we have been advised by the county that an agenda item has been placed on the next Board of County Commissioners meeting. This agenda item is referring to a request by the county to have the commissioners consider having the County Attorney pursue litigation against the property owners regarding their reported activities.
The meeting is scheduled for Tues 10/18. The agenda states that although the meeting starts at 9am, this agenda item will not be considered until after 2pm. The meeting is to be held at Centennial Hall Auditorium, 200 S. Cascade Avenue, Colorado Springs, Colorado.
Several board members will be in attendance, but our attorney has advised us that having residents in attendance possibly offering comments can help our position.

Picnic is this Saturday 8/27 at the Nevins Park at 12 noon. Please bring a chair and side dish. The HOA will provide drinks and grilling meats.
We have several important issues to discuss including a rewording of the covenants to address strengthening the language regard what constitutes a single family residence and what is an acceptable home business.
Look forward to seeing you there.

I live at almost the very bottom of the district and noticed last night a reduction in pressure. As of 7am today (Fri) we have just a trickle of flow left which I assume means those of you higher up are dry. The FVAWD website has no notice posted but in a recent call they indicated that a water break was reported last night and a tech "probably" has arrived by 7am. There was no more information.
